This is the first election cycle in the Morongo Basin where forced district elections will take away the rights of everyone to fully participate in the American democratic process. For the first time in my life as a citizen here, I am not allowed to vote for the entire Morongo Basin school board, or for my complete local City Council. My right to express my voice at the ballot box has been silenced because I do not live in one of the gerrymandered districts now forced upon our community.

This is the appalling result of one party political rule in California that endorsed a liberal social engineering agenda to dictate the dismantling of the time-honored open general election process. The proponents of forced district elections believe that individuals cannot stand on their own merit to achieve elected office without gerrymandered districts. The longstanding tradition of the open general election process has always guaranteed the complete participation of the whole community until now.

The new compulsory districts gratuitously implemented by this flawed legislative edict have no demonstrable merit for our communities. The attorney who has been granted a reprehensible immunity to enrich himself at the public expense is conducting an outrageous conspiracy to destroy the general election practice statewide.

My liberal friends who have also lost their full right to vote as result of this pretentious mandate have been conspicuously silent in addressing a social conscience on this issue. This is a challenge to those of the liberal ruling party to explain how fostering this cynical narrow-minded vision of a republic literally dividing us into special districts of less opportunity to vote promotes a better social order. The essential purpose of democracy is to be inclusive of all, not to divide and exclude. Please explain to me and the rest of the people in the Morongo Basin who now have involuntary limited voting rights how this make us a better society. I would welcome you to take a principled stand with me to correct this injustice from your own party to protect our community elections. I am standing up and fighting to defend your right to fully vote too.

Note to Mr Bagley: Crazy rants like this are why you live in a one party state.

Court challenges to district elections in California have not been successful. We know that because the California Voting Rights Acts and resulting court decisions have shot down cities that have sought relief from being sued for violations of the voting rights act. I submit, don't get upset with our coveted voting rights, get mad at justices who applied the law fairly and accurately. If the council has another 30 million to spend on another redux downtown project phoenix, including two steel superstructures building and the theatre 29 building, it easily could have said NO to the public interest attorney who has changed the way California citizens vote. But they did not.

Jim Bagley is spot on his assessment. Court challenges towards district elections have not been successful because of the "liberal social engineering agenda" of both politicians and the courts. It is not up to the people to decide if we desire local district elections. It is forced upon us by the government much like the property tax assessments and fees to get around proposition 13. I do not get mad at the justices of the court that ignore the people that wish to address their grievances towards the way our government conducts business and elections. I get mad at the politicians who appoint them specifically to support their social engineering agenda . Saying no to that liberal "special interest attorney" that changed our local elections would had wasted more tax payer dollars than "project phoenix" with even less in return.

TTJ, do you always have to be so hateful toward anyone that is not a Republican?. You make so many good points and arguments, but your hatefulness toward good Americans wears thin. Happy weekend.

TwoToeJoe

Gee Branson, was the "hatefulness" attributed towards my use of the term "liberal social engineering agenda" that offended you? Maybe instead of attempting to end the conservation by deeming a response as "hateful" and ending with "have a good weekend" you should had spent a little more time explaining why it should be deemed as such. Maybe expound on the actual issue on why the new mandate of local district elections are making a difference here in the Morongo Basin . I already know the term 'liberal" offends as you have already made clear. I would guess anything related to a disagreement between opposing viewpoints could be considered as "hateful" in certain people's mind. The government mandate requiring local district elections that is forced upon us is hateful and not the other way around. Do a little digging around and find out who exactly are these wonderful politicians and their supporters who love these mandates along with the additional fees, taxes, and assessments we deal with almost daily.

I have an off-topic question for Branson Hunter. Branson, a few weeks ago I posted a comment here on the HDS site. Much to my surprise, I found the same comment on Vote 29 or Cactus Thorns. I don’t recall me giving anyone permission to use what I wrote on here to be reprinted on CT. Next time you or anyone else representing CT wants to use my intellectual property, I suggest you ask my permission first. Thanks! M-

Branson Hunter

Mark, with due respect, permission is neither needed nor should it be presumed that permission should be asked beforehand. This is the standard across the US in terms of US Codes and court cases. It pertains to electronic news and alternative news outlets, that include cactusthornss and blogs. I posted in accord with 17 U.S. Code § 107 – Limitations on exclusive rights: Fair use: Fair use is a limitation and exception to the exclusive right granted by copyright law to the author of a creative work. In United States copyright law, fair use is a doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. Fair use is one of the traditional safety valves intended to balance the public’s interest in open access with the property interests of copyright holders. Second, when someone post comments or stories in social media it then becomes prone to public access. Take a look at the leading news stories that are posted in scores of national popular news interests: E.g., Huffington Post, Youtube is all over the place with network, cable and satellite news from all the major American news sources. I hope you do not harbor ill feelings, such a Z107.7 News Director. He threatened and bullied me for over a year because on occasion I posting a partial story or full Z story in cactusthorn. The threatened me with nasty emails. I retorted if he would sue me he would loose and I would sue him for abuse of process and other causes. The news director was educated and he ceases harassing me. I’m guessing the attorney he threatened to unleash on me advised him to accept federal laws, change them and quit whining bloggers making use of Fair Use. THE EXCEPTION is images, pictures, etc. They are copyrighted.

@Mark Simpson: What is posted online in is not secure and is out there for republication. Social media included 17 U.S. Code § 107, but it is also put out for public use because it's in the pubic domain. There are numerous federal laws in addition that protect bloggers from lawsuits. America is a country with free speech in place. Courts are very predisposed to upholding constitutional rights, especially when it concerns free speech privileges. Sometimes we may not like it but the greater good is served. Thus, what I posted in tems of you comments is protected as a free speech right of anyone who desires to republish your stuff.

Branson, it’s Mark Simmons. Not Simpson. I still would’ve appreciated a “heads up” as I’d of cleaned it up and made sure there weren’t any errors in it. Is life that boring for you that you feel the need to troll and look for stories to put on Cactus Thorns? Where I am from there’s a little thing called class. While you may be right, you showed a lack of class in doing what you did. I for one do not appreciate it. I’ve seen cactus thorns. Let me just say that I am not impressed in the least with it. But do you go ahead and do what you need to do. I know what kind of life I lead. It would’ve been nice had you gotten a hold of me and we could’ve maybe had beer and discussed it further. For right now buddy I don’t wanna have anything to do with you! Good day sir.

P.S. I suppose this will be on CT as well. BTW it’s lose. Not loose. When speaking about someone losing in the court of law.

Mark Simmons

Branson, go ahead and live your pathetic life. Seems to me from how others respond to you, you don’t command a tremendous amount of respect. Troll away pal! I’ve got way better things to do than to debate who those I DO NOT RESPECT! Later Ben! P.S. When responding to me it’s Mr. Simmons to you. Only my friends call me by my first name. Now shoo fly, shoo! Go play in the desert far away and with the other malcontents over at CT.
